Terms of Service: Basic Hosting Package

These Terms of Service (the “Agreement”) govern the use of our Basic Hosting Package provided by Moor Marketing Agency (“we,” “us,” or “our”) to the client (“you” or “your”). By subscribing to our services, you agree to the terms outlined below.

1. Service Description

Our Basic Hosting Package is a web hosting service priced at $49 USD per month, offering the following features:

SSL Certificate: Provides secure data encryption for your website.
Core Updates: We will ensure your website’s core software is updated regularly to maintain functionality and security.
100,000 Visits/Month: The package includes up to 100,000 visits per month. Any overage will be subject to additional charges as detailed in section 6.
20GB Local Storage: You are allocated 20GB of local storage for website files, databases, and other digital assets.
100GB Bandwidth/Month: The package includes 100GB of bandwidth per month. Exceeding this limit will incur additional fees as outlined in section 6.
IT Support During Business Hours: You will have access to IT support during our business hours (7am to 8pm AEDT), for general website maintenance and hosting issues.
4 Hours Remote Support/Month: You are entitled to 4 hours of remote support per month for troubleshooting, customizations, or other technical assistance.

2. Billing and Payment

Payment: You will be billed $49 USD monthly for the hosting package. Payments are due on the package start date (as per your subscription invoice) of each month, starting from the date of subscription.
Payment Methods: We accept Visa, Mastercard, Amex (and any other service as outlined by our payment provider).
Late Payment: If payment is not received within 14 days after the due date, we reserve the right to suspend services until payment is made.

3. Support Services

Business Hours Support: Support services are available during business hours (7am to 8pm AEDT) for assistance with hosting issues, server management, and general inquiries.
Remote Support: You are entitled to 4 hours of remote support each month. Any additional remote support beyond 4 hours will be charged at our standard rate of $90 per hour.

4. Acceptable Use

You agree to use the hosting services for legal purposes only. You may not:

Use the service to host unlawful, abusive, obscene, or infringing content.
Engage in spamming, hacking, or unauthorized access to other servers or accounts.
Exceed the allocated resources (storage, bandwidth, or visits) without additional payments.

Failure to comply may result in suspension or termination of services.

5. Data Backup

We will maintain regular backups of your website data; however, it is your responsibility to maintain your own backups. We are not liable for data loss, corruption, or any interruptions in service resulting from a lack of backup.

6. Overages and Additional Charges

If you exceed the allocated limits of your hosting package (100,000 visits/month, 20GB storage, or 100GB bandwidth), the following overage fees apply:

Visits Overage: Additional visits beyond 100,000/month will be charged at [insert cost per 1,000 visits].
Storage Overage: Exceeding the 20GB storage limit will incur an additional charge of [insert cost per GB].
Bandwidth Overage: Bandwidth usage beyond 100GB/month will be charged at [insert cost per GB].

7. Termination and Suspension

Termination by You: You may cancel your hosting package at any time by providing written notice to us. Cancellations will take effect at the end of the current billing cycle.
Termination by Us: We may terminate or suspend your hosting services for failure to comply with these Terms of Service or for non-payment.
Refund Policy: Payments are non-refundable unless otherwise specified in special promotional terms.

8. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any direct, indirect, incidental, or consequential damages arising from your use of the hosting services. Our total liability is limited to the amount you have paid us in the last 12 months.

9. Modifications

We reserve the right to modify these Terms of Service at any time. We will notify you of any significant changes via email or through our website.

10. Governing Law

This Agreement is governed by and construed in accordance with the laws of [insert jurisdiction].
